GDPR Privacy Policy

The General Data Protection Regulation (GDPR) comes in to effect on the 25th May 2018 and affects the way we keep information about you. Whilst we have always kept your personal information safe and private, there is now a legal requirement to do this.

This privacy statement sets out the way we use and store your personal data, why we hold it and how we protect it. It sets out your rights of access to that data and how you can have it removed if you wish.

What information we hold and why

The information we hold about you may be from our initial visit or from emails, letters or telephone calls. The information that we may collect is:-

• Contact information including email addresses, telephone numbers and postal address
• NI number and date of birth
• Tax reference number
• Other relevant information that may be needed ie employment records, pension providers

This information is important to us as it enables us to provide the services you have requested and will not be used for any other purpose.

Why we use your personal data

Derbyshire & Co, as a Data Controller, is bound by the requirements of the General Data Protection Regulations (GDPR).

You agree that we are entitled to obtain, use and process the information you provide to us to enable us to carry out the Services (as defined in our Letter of Engagement and supporting Schedules)and for other related purposes including;

• Statutory returns
• Legal and regulatory compliance
• Crime prevention.

We may receive personal data from you for the purposes of our money laundering checks, such as a copy of your passport. This data will only be processed for the purposes of preventing money laundering and terrorist financing, or as otherwise permitted by law or with your express consent.

How do I know the data you collect is secure

When you give us personal information, we keep it secure. Any sensitive information (such as credit or debit card details) is encrypted and protected.

Non-sensitive details (your email address etc.) that are sent over the Internet can never be guaranteed to be 100% secure. We cannot guarantee the security of any information you transmit to us and you therefore do so at your own risk.

How long will we hold your data for?

For our normal services contained in your engagement letter we will hold your data for 7 years in line with our regulatory requirements.

We may, in certain circumstances keep information for longer than this but only where it is necessary.

For example:- purchase of property completion statements- we would need to retain the information until the properties are sold. The reasons to hold information longer than 7 years will be regularly assessed and where information is no longer required it would be destroyed or returned to the client.

Access to your information

We try to keep your information correct at all times but it is your responsibility to let us know of any changes to your personal information.

You have the right to lodge an objection to the processing of your personal data.

You have the right to request correction of the personal data that we hold about you. This will allow you to have any incomplete information or inaccurate information we hold about you corrected.

You have the right to receive the personal data which you have given to us.

Complaints

If you feel that your personal data has been processed in a way that does not meet the GDPR requirements, you have a specific right to lodge a complaint with the Information Commissioner’s Office.
